In these Terms and Conditions “we” and “us” mean Sambag Pty Ltd As Trustee For the Sam Cooney Family Trust Trading As Sambag ABN 69 890 689 554, the Website Owner, and “you” means you the customer or site visitor.

Please read the Terms and Conditions carefully before placing any orders on www.sambag.com.au

These Terms and Conditions together with your order constitute the entire contract between us and you for the supply of products. No other Terms and Conditions will apply. The contract may not be altered unless agreed to by us in writing or via email.

From time to time we may change the Terms and Conditions on www.sambag.com.au . Please make sure you have read our Terms and Conditions at the time of purchase.

Sale Conditions

The range of products may vary from those available in our boutiques. If a product page is displaying the red “sold out online” circle, please contact our boutiques for alternate stock availability of the item you are interested in. If you wish to enquire about a style your have seen but cannot find online please email us at online@sambag.com.au and we will endeavour to respond to your style request as soon as possible.

Sambag strives on providing excellent customer service to all its customers, and we are determined to ensure you are happy and satisfied with your order. If you have any concerns or questions regarding your order please email online@sambag.com.au and we will try our best to rectify the situation for you as soon as possible.

Prices

Sambag always seeks to list products at competitive prices. Sambag reserves the right to change prices for products displayed on our online site at any time. The price payable for the Goods shall be THE price applicable on the date the Goods are confirmed as ordered. Advertised prices are in Australian Dollars and are all inclusive of GST. Sometimes typographical or human errors may occur, in which case we will try our best to quickly rectify, but we hold no responsibility for.

GST

On all Australian orders, Sambag Online prices are inclusive of the 10% GST charge on purchases. On International Orders, no Australian GST is charged.

Currency

All prices shown are in Australian Dollars.

Colours

Please note that colours of products will sometimes vary depending on the quality and make of the computer monitors they are being viewed on.

Order Acceptance

Once order placement has occurred, you are engaged in a contract that sees you unconditionally accept the prices and descriptions of the items you have ordered. Once an order has been placed with Sambag Online, you will receive an email confirmation of payment. This email does not promote acceptance of the order, it is simply a confirmation that we have received it.

Unless an order is cancelled by you - the buyer -,order acceptance does not occur until Sambag has emailed you informing you that your order has been dispatched. Once this has occurred, the sale contract has concluded.

If we are unable to obtain authorisation for payment or in the case where we may suspect fraudulent use of credit card – we reserve the right not to accept your order. We also reserve the right to not accept your order if certain shipping restrictions apply for the area of delivery, or if the item ordered is out or stock or withdrawn from sale for any particular reason.

Payment Information

Payment can be made using Visa, MasterCard or American Express. Payment will be processed as soon as your order has been submitted. In the event that your order cannot be filled – a refund for the full purchase amount will be processed immediately.

By placing an order online you are confirming that the credit card you are using belongs to you. All credit card holders are subject to validation and authorisation checks by the card issuer. This is especially relevant for overseas orders.

All credit card transactions on Sambag Online are processed using eWay, a secure online payment gateway that encrypts data obtained from customers using Ingrian Devices to provide the highest level of protection available. Ingrian devices provide tamper-resistant protection of cryptographic keys to ensure encrypted data is kept private and secure.

Delivery Information

When estimating the delivery time of your goods please consider the following;

• Order processing will not commence until credit card authorisation and address verification has occurred.

• Orders which are placed after midday will not be downloaded into the system for processing until the next day. Therefore unless you place your order before 12pm, it will not be actioned until the following day.

• Please allow at least 1-2days handling time before your order is dispatched. Where possible we will try to process orders for shipment on the same day of purchase, but this will vary depending on the quantity of orders at any given time.

• In the case of incomplete delivery, shipping will only be charged for the first delivery.

• Orders which are placed over the Weekend or on a Public Holiday will not be processed until the next business day, at the earliest. Business days are Monday to Friday, excluding NSW Public Holidays.

• Please note when completing your order form to include a valid Street Number, Suburb, Post Code and Phone Number. Orders cannot be processed without this information, and Sambag will not be held responsible for any delays incurred because of this missing data.

• Please be sure to provide an address THAT will be attended when delivery occurs. Sambag uses a courier service to deliver our products – but in the event of the shipping address being unattended, Sambag reserves the right to leave the parcel at the delivery address without requiring signature. In the best interest and safety of your order – please consider sending your parcel to a location that is occupied between the working hours of 9am-5pm Monday to Friday.

• If your order does not arrive more than two days after dispatch confirmation email is sent, please contact us at online@sambag.com.au.

• If you are purchasing from Sambag Online from any country other than Australia, longer delivery estimation applies. For orders to New Zealand, please allow at least 1 week from confirmation dispatch email for your order to arrive. For orders being delivered to anywhere other than Australia or New Zealand please allow at least two weeks in order to receive your parcel.

Returns and Exchanges

 

Please be aware that all SALE items purchased from Monday 13/02/2012 as part of our Sale will not be elidgible for either a refund or exchange so please choose carefully.

 

At Sambag we will happily exchange or refund you for unsuitable items where intent to return item has been emailed to online@sambag.com.au, no longer than 7 days after date of delivery. If we are contacted outside the 7 day limit, Sambag may refuse any requests for exchange or refund.

Items exchanged will be exchanged at the retail prices/values that were effective on the date of the original transaction. Full refunds are only available on Full Price items. Where a sale item has been purchased, customers are welcome to exchange* but not refund this item. Exchange of sale goods – must only be in exchange for other sale items. Any refunds processed will NOT include refund of the postage fee - only the amount of the item purchased. Please note: Refunds and exchanges are not accepted on swimwear and jewellery due to health regulations. Please also note that purchases online cannot be exchanged at any of our Sambag Boutiques. The Sambag Online store is a completely separate entity to our Sambag Boutiques.

It is our Company Policy that under no circumstances are customers allowed onto our warehouse premises. For any exchanges or returns, product must be posted back to Head Office at the customer’s expense. In the event of a faulty item, once the product has been received back at Head Office and deemed a manufacturers fault, and not in its state due to wear and tear, we will refund the postage amount incurred if you include a receipt with the product.

Returns will only be accepted if the item is in perfect condition, and sent along with original email invoice. Any returns must be sent in new and unused condition – with all packaging, boxes and tags attached.

 

Return of goods via mail

Before returning goods please send us an email to online@sambag.com.au describing the problem or reason for return. We will then email you with the return address and return number. When approved, the item/s must then be forwarded to Sambag by registered mail. For countries other then Australia please indicate ‘return of non conforming merchandise’ on customs forms. Upon Sambag receiving the item/s, allow 1-2 weeks from the day you return your goods to process the return, whether it be the exchanged goods delivered to you, a refund, or a credit note issued. You, the customer, will be responsible for shipping and handling charges associated with returns, however Sambag will not charge additional shipping on exchanges. Refunds will be made within two weeks of the return of the product.

SAMBAG GIFT VOUCHER TERMS AND CONDITIONS

  1. Gift Vouchers are valid for 6 months from date of purchase.
  2. Gift Vouchers can be redeemed against all products on the Sambag website (www.sambag.com.au) or in any of the Sambag stores.
  3. Gift Vouchers are non transferable and may not be returned or redeemed for cash.
  4. If your order exceeds the value of the Gift Voucher, the remaining balance must be paid by credit card.
  5. If you wish to return products you have purchased using a Gift Voucher, you are not entitled to a refund - however you are welcome to exchange for another product.
  6. Sambag Gift Vouchers can be used on sale items.
  7. Sambag is not responsible if a Gift Voucher is lost, stolen, destroyed or used without permission.
  8. Sambag reserves the right to cancel a Gift Voucher if we deem such action necessary.
  9. Promotional codes cannot be applied to the purchase of Gift Vouchers.
  10. Sales tax and shipping is applicable on any products purchased with a Sambag Gift Voucher.
  11. Shipping is free for any Sambag Gift Voucher provided it is not purchased with any other product, and it is being delivered within Australia only.

Sambag makes no representation, whether express, implied in law or residual, as to the sequence, accuracy, completeness or reliability of the information contained in the website. Sambag does not accept responsibility for any errors, or omissions in the site contents. Although, SAMBAG will be pleased to correct any errors displayed on our webpages. SAMBAG reserves the right to change or discontinue any aspect or feature of this website. SAMBAG intends to use royalty-free material for the site and not to use any copyrighted material. If this occurs, we’ll remove it. SAMBAG does not accept any liability for any loss or damage suffered (directly or indirectly) by making use of the site’s information. Nor can we guarantee that pages will display correctly in all web browsers or that the website will be online at all times. We cannot accept responsibility for events publicised on our site and we advise anyone planning to attend at an event listed to recheck details. SAMBAG cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may happen when accessing this website. With any Links posted, the onus is on the visitor and SAMBAG is not responsible in any way for any of their contents.

Legal capacity to transact

If you are under the age eighteen (18) years you CANNOT place orders with Sambag. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. Should Sambag suffer any damage or other losses as a result of a transaction entered into by a minor, Sambag reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Sambag.

Our liability

We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Our maximum aggregate liability for any products supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the products(s) in question.

Credit card fraud

Whilst Sambag employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, Sambag will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an un-authorised manner.

Force majeure

Sambag shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Sambag, and Sambag shall be entitled to a reasonable extension of time for the performance of such obligations.

Governing law

These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales Australia and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales Australia.

Other terms

Our website is provided in the state of New South Wales, Australia and conditions of use are subject to Australian law which governs this User Agreement. We do not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances beyond of our control.
